One of Lefty's Favorite Games: "Hide the Subpoena"

Some time ago, Chief Adams had a buddy who was at his beck and call. We’ll just call him B.M. Lefty had it pretty good as B.M. would cut his grass, wash his car, clean his in-ground pool, etc. One day B.M. was charged with the theft of a woman’s purse from a bar on Kennedy Avenue. For the arresting officers, both of whom have moved on to greener and sunnier pastures, police work went on as they went about their business awaiting B.M.’s trial.

A few months later, those same officers were in criminal court for another matter. Neither officer ever received a subpoena for B.M.’s theft case but when they walked into Judge Donna Jo McDaniel’s courtroom, B.M. was there. Surprised by the officers, he stood up and asked “You guys aren’t here for me, are you?” The officers said no, they were on another case. B.M. then told them that Lefty gave him his subpoena and told him to just show up and that everything would be ok. B.M. said that Lefty told him “The victim is not coming and my guys won’t be there either.”

Is this not Obstruction of Justice?
